Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the CityVibe mobile application ("App", "Service") operated by Berat Yasa, based in the Netherlands ("we", "us", "our").

By creating an account or using CityVibe, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Description of Service

CityVibe is a city guide application that provides:

• Curated lists of places of interest across cities worldwide
• Map-based exploration and search functionality
• The ability to save favorites and create personal lists
• Premium content through optional paid subscriptions

Content in CityVibe is curated for informational and entertainment purposes. We do not guarantee the accuracy, completeness, or current availability of listed places (opening hours, prices, existence, etc.).

3. Account Registration

To use certain features of CityVibe, you must create an account using either Sign in with Apple or an email address and password.

You agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us promptly of any unauthorized access
• Not create accounts for others without their permission
• Not create multiple accounts for abusive purposes

You must be at least 16 years old to create an account (in accordance with Dutch law under the UAVG).

4. Free and Premium Services

4.1 Free Tier

CityVibe offers a free tier with access to selected categories of places. Free access may be limited or changed at our discretion.

4.2 Premium Subscription

CityVibe Premium ("Premium") provides access to all categories, curated lists, and premium features. Premium is offered as an auto-renewable subscription through the Apple App Store.

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• Any unused portion of a free trial period is forfeited when you purchase a subscription

4.3 Refunds

All subscription payments are processed by Apple. Refund requests must be directed to Apple through their Report a Problem page, in accordance with Apple's refund policy and applicable consumer protection laws.

Under EU consumer protection law (Directive 2011/83/EU), you have the right to withdraw from a digital content purchase within 14 days, unless you have expressly consented to the digital content being provided immediately and acknowledged that you lose your right of withdrawal.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Scrape, copy, or extract data from the Service by automated means
• Reverse engineer, decompile, or disassemble the App
• Use the Service to distribute spam, malware, or harmful content
• Impersonate others or misrepresent your affiliation
• Reproduce, redistribute, or commercially exploit the curated content without permission

6. Intellectual Property

All content in CityVibe, including but not limited to curated place descriptions, list compilations, design elements, graphics, and software code, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create within the App (such as custom lists and notes). By using the Service, you grant us a limited license to store and display your content solely to provide the Service to you.

7. Third-Party Content and Services

CityVibe displays information about third-party businesses and locations. We are not affiliated with, endorsed by, or responsible for these businesses. Information such as opening hours, prices, and availability may change without our knowledge.

The App uses Apple MapKit for map services. Your use of map features is also subject to Apple's Maps terms.

8. Disclaimer of Warranties

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We do not warrant the accuracy or reliability of any place information, recommendations, or content
• We are not responsible for any decisions you make based on information in the App

Important: This disclaimer does not affect your statutory rights as a consumer under EU and Dutch law, which cannot be limited or excluded.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of data, profits, or business opportunities
• Any damages arising from your use of or inability to use the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

Note: Nothing in these Terms excludes or limits our liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under applicable law.

10. Account Termination

10.1 By You

You may delete your account at any time through the App (Profile > Data & Privacy > Delete Account). Account deletion is permanent and removes all your data as described in our Privacy Policy.

If you have an active subscription, deleting your account does not automatically cancel your subscription. Please cancel your subscription through Apple ID Account Settings before deleting your account.

10.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in abusive or harmful behavior
• Use the Service in a way that could harm other users or our infrastructure

We will provide reasonable notice before termination where possible, unless immediate action is required to prevent harm.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or via email at least 30 days before the changes take effect.

If you continue to use CityVibe after changes take effect, you accept the updated Terms. If you disagree with the changes, you may delete your account before the changes take effect.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles.

For EU consumers: you retain the protection of the mandatory provisions of the consumer protection laws of your country of residence.

12.1 Dispute Resolution

We encourage you to contact us first at support@cityvibe.app to resolve any disputes informally.

If a dispute cannot be resolved informally, it shall be submitted to the competent court in the Netherlands. As an EU consumer, you may also use the EU Online Dispute Resolution platform.

13. Apple App Store Terms

These Terms are between you and CityVibe, not with Apple. However, as the App is distributed through the Apple App Store, the following applies:

• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims relating to the App
• Apple is a third-party beneficiary of these Terms
• Your use of the App must comply with the Apple App Store Terms of Service

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CityVibe regarding the use of the Service.
